Ante Nuptial Contract - before marriage an agreement between two parties about the terms of their marriage

Your Estate - includes everything you own and everything you owe.

Marriage in Community - of Property is the default option in South Africa. Here’s how it works:
Your assets and debts combine into a joint estate. Both spouses share ownership of everything in the joint estate. You are both equally responsible for any debts. Your ability to make certain financial decisions may be limited without your spouse's consent. When the marriage ends: By death: The joint estate is split between your spouse and your heirs. By divorce: The estate is divided equally between both partners.

Marriage out of Community of Property - is only possible if you conclude an antenuptial contract before marriage. This means:
No joint estate is formed. You keep ownership of your assets. You are solely responsible for your debts. You have full control over your financial decisions. When the marriage ends (by death or divorce) your estate remains separate from your spouse's. You have the option to include or exclude the accrual system.

Accrual - is the increase in each spouse's net asset value during the marriage. The goal is to share the profits fairly, regardless of who earned more. Here’s how it works:
Calculate each spouse's net asset value when you get married. Calculate it again when the marriage ends. The accrual is the difference between the starting and ending values. The spouse with the smaller accrual can claim half of the difference between the two accruals, allowing both partners to share equally in the growth of their estates.
